3-38 Fines and penalties

ARTICLE II. DOGS*

Sec. 3-38. Fines and penalties.

(a) Any person who shall neglect or refuse to comply with an order issued under section 3-31[Complaints about dogs] or 3-32 [Restraint or muzzling of dogs], or who shall be in violation of section 3-33 [Disturbance of the peace by dogs] shall be liable to a penalty of not more than $25.00. Each day of violation shall constitute a separate offense.

(b) Any person who shall be in violation of section 3-34 [Dogs at-large] shall be subject to a fine of $25.00 for each occasion.

(c) Any person who does not properly curb his or her dog shall be subject to a fine of $25.00.

(d) Any person who shall be in violation of section 3-37 [Confinement of dogs during oestrus cycle] shall be liable to a penalty of not more than $25.00.

(e) Any person found in violation of any part of this chapter, or ordered to restrain or dispose of his/her dog under Section 157 of Chapter 140 of the General Laws of Massachusetts, by the animal control officer, the chief of police or a court, shall have his/her permit or license to own, keep, harbor, or have custody of animals revoked and no new permit or license shall be issued.
